The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.
The prosecution case as per the written report of Amarjeet Kumar dated 07.09.2017 submitted to the Station House Officer of Laheri Police Station is to the effect that the petitioner took Rs. Five lakhs from the informant as a loan and against which, the petitioner executed an agreement on a letter pad and when the informant demanded the aforesaid amount from the petitioner then the informant was threatened for dire consequence.

No.68034 of 2018(2) dt.17-12-2018 2/2 It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment and though, the petitioner is accused in other case but he is on bail. Learned APP submits that the petitioner is named in the FIR with specific accusation.
Considering the contractual nature of dispute, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 380 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
