Petitioner apprehends his arrest in a case registered under section498(A)/34 of the Indian Penal Code. Prosecution case, in brief, is that after the death of ex-husband the informant married with the petitioner and after some days of marriage her husband told to the informant to go with him to his home and after taking jewelry she came to the house of her husband thereafter he husband and other co-accused persons started torture and demanded she buffalo from her and due to non-fulfillment of demand she was assaulted and ousted from her matrimonial house.

It is submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.29519 of 2015 (2) dt.28-07-2015 2/2 petitioner has no criminal antecedent. It is further submitted that as per the prosecution case petitioner is the second husband of the informant. The same is denied by him. It is submitted that the informant happens to be the cousin sister-in-law (Bhabhi) of this petitioner and he was never married to her. Petitioner is married to another lady with whom he is residing at present. On behalf of the State it is submitted that petitioner is named in the first information report. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Jhanjharpur, Madhubani in Phulparas P.S. Case No. 295 of 2012, subject to the conditions as laid down under section 438(2) Cr.P.C.
