2. This is the second attempt for bail of the petitioners as earlier such prayer was rejected by order dated 16.04.2024 in Cr. Misc. No. 7527 of 2024.

3. The petitioners seek bail in connection with Chand P.S. Case No. 200 of 2023 registered for the offence punishable under Section 304(B) of the Indian Penal Code.

4. The petitioners are the father-in-law and mother-inlaw of the deceased. The deceased was married in the year 2021. She was tortured for dowry and was killed by administering poison.

5. Learned counsel for the petitioners submits that the deceased had taken poison herself and the petitioners being old aged persons may be granted bail as they are in custody since

6. Learned APP for the State has opposed the prayer for bail of the petitioners and has submitted that the trial has started and one witness has been examined.

7. I have considered the submission of the parties. The petitioner no. 1 is the father-in-law of the deceased. The main thrust of allegation is against the mother-in-law i.e., petitioner no. 2 because of whom this entire occurrence has taken place. Moreover, the trial has started.

8. In the above circumstances, the prayer for bail of petitioner no. 1 is allowed.

9. Let the petitioner no. 1, namely, Sudama Bind be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-V, Kaimur at Bhabua in connection with Chand P.S. Case No. 200 of 2023.

10. So far as the bail application of petitioner no. 2, namely, Lalita Devi @ Lalati Devi is concerned, the same is dismissed.
