JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 4 11-01-2017 The petitioner has renewed his prayer for bail in connection with Chakiya P.S. Case No. 246 of 2015 registered for the offences punishable under Sections 302, 201 and 120-B of the Indian Penal Code.
2. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 19.05.2016 passed in Cr. Misc. No. 21722 of 2016.
3. In paragraph no.2 of the petition filed on behalf of the petitioner reads as under :- "2. That the petitioner has not moved earlier either in anticipatory bail or for regular bail
Patna High Court Cr.Misc. No.46648 of 2016 (4) dt.11-01-2017 2 / 2 before this Hon'ble Court regarding this matter."
4. Apparently, a false statement on oath has been made in paragraph no.2 of the petition. The petitioner is trying to obtain bail by practicing fraud upon the Court.
5. It is a serious matter. When confronted, Mr. Bakshi S.R.P. Sinha, learned Senior Counsel submitted that he has been engaged in this case by Mr. Ramendra Kumar Bharti and Mr. Anand Kishore Chaudhary, Advocates, who have filed this case. He tendered unqualified apology for any act of omission or commission on the part of the Advocates on record.
6. The conduct of the petitioner is reprehensible. However, at this stage I say no more. The advocates appearing in this case are warned to be cautious in future.
7. The application is dismissed.
