JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in connection with Gobardhana P.S. Case No. 19 of 2016 registered under Sections 414/34 of the Indian Penal Code and Section 11 of the Prevention of Cruelty to the Animals Act.

It is contended that the petitioners were apprehended by the Police on suspicion of being cattle smugglers. There is no allegation that the petitioners were assisting in concealment of any stolen property and, hence, the ingredients of the offence under Section 414 of the Indian Penal Code would not be made out. It is further contended that the petitioners having no criminal

Learned counsel for the State has opposed the application for bail to the petitioners.

Regard being had to the facts and circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of A.D.J. 1st Bagaha, in connection with Gobardhana P.S. Case No. 19 of 2016.
