This is an application for bail in connection with Hajipur Town P.S.Case No. 118 of 2016 registered for the offences punishable under Sections 414 IPC, 25(1-b) A, 26, 35 of the Arms Act and Sections 20 and 22 of the NDPS Act. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and arrested in a case under Section 379 IPC and remanded in all the cases. Though there is allegation under NDPS Act the petitioner has remained in custody for 11 months.
Heard learned APP also.
Having heard both sides and considering the facts and circumstances of the case, I am not inclined to grant bail to the
Patna High Court Cr.Misc. No.809 of 2017 (2) dt.02-02-2017 2/2 petitioner.
However, having considered the fact that the petitioner has remained in custody for 11 months, learned court below is directed to expedite the trial of the case of the petitioner and conclude it within nine months. Learned court below will issue notice to the Superintendent of Police concerned with a direction to produce the witnesses on each and every date and on failure on the part of the S.P. concerned, he may inform this Court about the same.
With the aforesaid observations, this application is dismissed.
