The petitioners seek bail in Kundwachainpur P.S. Case No.126 of 2018 registered for the offence under Sections 272, 273, 414/34 of I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act.

Accusation is that on 08.2018 in course of patrolling two persons were apprehended on motor cycle who disclosed their names as the petitioners Premchandra Kumar and Brajesh Kumar and on their disclosure the petitioner being S.I. of police intercepted a car bearing Registration No.BR1X-5701 to which one person was arrested who disclosed his name as Awadhesh Kumar and on search 150

Patna High Court Cr.Misc. No.62494 of 2018 (2) dt.08-10-2018 2/2 bottles each containing 300 ml of Nepali Soufi Wine kept in a sack and 225 bottles each containing 300 ml. of Kasturi wine kept in plastic bag were recovered from the car Submission on behalf of the petitioners is that both the petitioners were moving on the motor cycle and both were stopped by the informant but nothing has been recovered from their possession. Both the petitioners are in custody since 21.08.2018 having no criminal antecedent.

Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, East Champaran, Motihari in Kundwachainpur P.S.
