Petitioner is accused in connection with Bihpur (Bhawanipur) P.S. Case No. 109 of 2015 registered under Sections 498(A) and 302/34 of the I.P.C.

Petitioner is named in the F.I.R. but no specific overt act has been attributed against him, as the informant is not the eye witness of the alleged occurrence. Further submission is that petitioner has been made accused in this case only on suspicion and is in custody since 30.05.2016. It is also submitted that similarly situated co-accused persons namely, Raju Jha, Mukesh Jha and Mithilesh Jha have already been allowed bail by a Bench of this Court vide Cr. Misc. Nos. 25786 of 2016 and 44012 of 2015 on 29.09.2016 and 23.09.2015 respectively.

No.49928 of 2016 (2) dt.20-12-2016 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachiya, Bhagalpur in connection with Bihpur (Bhawanipur) P.S. Case No. 109 of 2015.
