1. The present petition has been filed for modifying the order dated 24.06.2023, passed in Cr. Misc. No.23722 of 2023, to the extent that the time granted to the petitioner to surrender before the learned Court below and avail the privilege of anticipatory bail be extended by a further period of four weeks.

2. The learned counsel for the petitioner has submitted that on account of communication gap, the learned counsel for the petitioner could not communicate the aforesaid order dated 24.06.2023 to the petitioner, resulting in him not being able to surrender before the learned Court below, within time, for the purposes of being granted the privilege of anticipatory bail, hence his case be considered sympathetically and the time granted to the petitioner to surrender before the learned Court below be

Patna High Court CR. MISC. No.58857 of 2023(2) dt.01-09-2023 2/2 extended by a further period of four weeks.

3. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the averments made in the present petition, I deem it fit and proper to extend the time granted to the petitioner to surrender before the learned Court of Additional Chief Judicial Magistrate, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No.18 of 2022, for the purposes of being released on anticipatory bail by a further period of four weeks from today. The rest of the conditions mentioned in the order dated 24.06.2023, shall remain as it is.

4. The present petition stands disposed off with the aforesaid modification in the order dated 24.06.2023, passed in Cr. Misc. No.23722 of 2023.
