The petitioner apprehends his arrest in Chandradeep P.S. Case No. 48 of 2014, registered for the offences punishable under Sections 324, 323, 506 and other Sections of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST (P.O.A.) Act. The petitioner took toddy from the shop of the informant and on demand of money the petitioner is alleged to have assaulted the informant with sickle on his hand causing injuries. Suresh Yadav is alleged to have assaulted the informant with iron rod.

It is submitted that the injuries caused by the petitioner on non-vital part of the body. The occurrence took place after taking toddy.

No.30021 of 2015 (2) dt.29-07-2015 2/2 Considering the facts aforesaid and the fact that three injuries was found to be grievous on the body of the informant, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
