JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-06-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 354A, 379, 504, 506, 34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other co-accused persons being armed with lathi and iron rod forcibly broken the safety tank of the informant and on objection, gave iron rod blow on the head of the son of the informant due to which he received fracture and bleeding injury and fell down becoming unconscious.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to previous enmity. He submits that there is case and counter case between the parties. He further submits that

Considering the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Uda-Kishunganj, Madhepura in connection with Chausa P.S. Case No. 171 of 2020.
