The petitioner seeks bail in Musrigharari P.S. Case No. 85/2016, registered for the offences punishable under Section 414 of the Indian Penal Code.

The police apprehended one Rakesh Sahni in connection with Musrigharari P.S. Case No. 80/2016 and he disclosed that the petitioner also purchased one stolen motorcycle from him. Rakesh Sahni also disclosed the name of two other accused persons including the name of Avinash Sahni and alleged that they also purchased the stolen motorcycle. Learned counsel for the petitioner submits that the petitioner is distant relative of Rakesh Sahni. The petitioner did not purchase any motorcycle from Rakesh Sahni. Rakesh Sahni

Patna High Court Cr.Misc. No.46367 of 2016 (3) dt.20-12-2016 2/2 brought the motorcycle and parked in the courtyard of the house of the petitioner. Similarly situated co-accused Avinash Sahni @ Avinash Kumar has already been enlarged on bail vide order dated 27.10.2016 passed in Cr. Misc. No. 46989/2016. The petitioner is in jail since 16.07.2016. He has already remained in jail for more than five months and he has got no criminal antecedent. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Samastipur in connection with Musrigharari P.S. Case No. 85/2016.
