JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Rajauli P.S. Case No. 377 of 2017, registered for offences punishable under Sections 30(a)/ 37(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 20 litres of liquor from the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner and although the recovery is said to be made from the the house of the petitioner but that house is the joint property. Further petitioner has been in custody since 10.01.2018. Heard learned A.P.P. also.

No.65522 of 2018(2) dt.22-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. -II-cum Special Judge, Nawada, in connection with Rajauli P.S. Case No. 377 of 2017.
