2. The petitioner seeks bail in connection with N.D.P.S. Case No. 30 of 2024 arising out of Mohania P.S. Case No. 138 of 2024 registered for the offence punishable under Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. As per the prosecution case, 5.99 grams of heroine has been recovered from the petitioner.

4. It has been submitted by learned counsel for the petitioner that the petitioner is in jail since 06.03.2024 having clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.55564 of 2024(2) dt.14-08-2024 2/2 of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd, Kaimur at Bhabua in connection with N.D.P.S. Case No. 30 of 2024 arising out of Mohania P.S. Case No. 138 of 2024.

7. The petitioner will also mark attendance in Mohania Police Station, Kaimur at Bhabua on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

8. While accepting bail bonds of the petitioner, the Court below will verify the fact about the antecedent of the petitioner. If the petitioner is found to be having clean antecedent, his bail shall be accepted. If the petitioner is found to be having antecedent, his bail bonds shall not be accepted. (Sandeep Kumar, J) P.
