The petitioner apprehends his arrest in Pear P.S. Case No. 19/2016, registered for the offences punishable under Section 353 and other sections of the Indian Penal Code. Sujeet Kumar S.H.O of Pear named the petitioner along with other accused persons and alleged that they all having armed with sticks, bricks came and put a dead-body on the road. The accused persons blocked the road. They were assaulting the passers-by and also pelted bricks and stones on the police personnel.
Learned counsel for the petitioner submits that the villagers had blocked the road, as one person was killed by unknown criminals. No specific allegation is made against the
Patna High Court Cr.Misc. No.46016 of 2016 (2) dt.28-11-2016 2/2 petitioner. Raj Kumar Paswan one of the co-accused has already been granted anticipatory bail vide order dated 29.08.2016 passed in Cr. Misc. 32268/2016. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge 5th -cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Pear P.S. Case No. 19/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
