JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Bakhtiarpur P.S. Case No. 258 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 384, 504 and 506 of the Indian Penal Code.
Petitioner is named in the F.I.R. and the allegation against the petitioner and other accused persons is of assaulting the deceased and the main allegation of assault is against coaccused Md. Ali Raja and Md. Nawab, who caught the deceased.
Submission of learned counsel for the petitioner is that though he is named in F.I.R., but no specific allegation of overt act has been attributed against the petitioner and he is in judicial custody since 29.07.2018.
Heard learned counsel for the informant also.

No.67144 of 2018(2) dt.27-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiarpur P.S. Case No. 258 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
