The petitioner apprehends his arrest in connection with Fatehpur P.S. Case No. 252 of 2019 registered under Section 307 and other allied sections of the I.P.C. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to admitted land dispute. Further he submits that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that in the first information report, there is direct allegation of assault by means of irrd due to which the mother-in-law of the informant sustained head injury.

Patna High Court CR. MISC. No.8644 of 2021(5) dt.10-03-2022 2/2 corroborates the same. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.
Having considered the facts and circumstances of the case and nature of the allegation as well as the submission advanced on behalf of the learned counsel for the State, this Court is not inclined to grant anticipatory bail to the petitioner.
