The petitioner seeks bail in a case registered for the offences under Section 392 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 09.08.2021, chargesheet has been submitted and has antecedent of two cases.

The learned counsel for the petitioner submits that the informant in the FIR alleges that he along with Ranjeet Singh were going to distribute the Gas upon a vehicle being driven by Pappu Kumar when they were intercepted by three criminal on a bike and snatched one bag containing Rs. 6461. It is further submitted that while fleeing, one of the accused was

No.63054 of 2021(2) dt.23-03-2022 2/2 apprehended by the local people who disclosed his name as Kundan Srivastava and further disclosed the name of the petitioner as a co-accused. The learned counsel for the petitioner submits that the petitioner has not been arrested from the spot and his name transpired in the confessional statement of Kundan Srivastava which has no evidentiary value. The learned APP vehemently opposes the prayer of bail.

Considering the fact that petitioner is in custody since 09.08.2021, chargesheet has been submitted and name of the petitioner transpired in the confessional statement and the petitioner was not arrested on the spot, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dalsinghsarai P.S. Case No. 214 of 2021. The application stands allowed.
