The petitioner seeks bail in a case instituted under Sections 25(1-B)A, 35 of the Arms Act.

The prosecution story in brief, is that two motorcycle borne criminals intercepted by the police and on search, country made loaded pistol along with nine cartridges was seized from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.04.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with nine live cartridges is said to have been

Patna High Court Cr.Misc. No.53092 of 2016 (2) dt.16-12-2016 2/2 recovered from the possession of the petitioner. There is no compliance of Section 100 of the Cr.P.C. The other co-accused has been granted bail vide Cr. Misc. No. 35510 of 2016. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Begusarai, in connection with Ballia P.S. Case No. 80 of 2016. (Sudhir Singh, J.) Amit/- U T
