The petitioner apprehends his arrest in Complaint Case No.3983 of 2016 for the offences allegedly committed by the petitioner under Sections 323, 341, 379 and 34 of the Indian Penal Code.

The complainant alleged that the complainant and other persons living in the vicinity had given Rs.88,000/- to the petitioner to purchase the land for construction of 12 feet road for their ingress and egress. It is further alleged that the petitioner and others damaged the said road.

Learned counsel for the petitioner submits that the entire allegation is false and concocted. The complainant and

The other accused persons have already been granted bail. There is no proof that the petitioner received any money from the complainant and others.

Having considered the facts and the nature of allegation made against the petitioner and the fact that the complainant although alleged to have handed over money to the petitioner for purchasing the land for construction of 12 feet road but the petitioner denied to have received any money, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIII, Patna in connection with Complaint Case No.3983 of 2016 (Trial No.733 of 2017), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
