Petitioners, who are in custody, seek bail in connection with Jehanabad Rail P.S. Case No. 62 of 2018 registered for the offences punishable under Sections 30(d) of the Bihar Mahua Flower Act, 2016 of the amending sections of 3, 5, and 18 of Mahua Flower Act, 2006.

Allegation against petitioners is recovery of 60 kilograms Mahua Flower Jawa, when they were unloading it from the train.

It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They have been falsely implicated in this case only on suspicion.

Patna High Court Cr.Misc. No.65000 of 2018(2) dt.05-11-2018 2/2 They have no concern with the alleged recovery. Nothing has been recovered from their possession. They have no criminal antecedent. They are in custody since 01.09.2018. Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, (Excise) Gaya in connection with Jehanabad P.S. Case No. 62 of 2018.
