JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections--25(i-B)A/26 of the Arms Act.

One loaded country-made pistol and four live cartridges were recovered from conscious possession of the petitioner while petitioner was caught ploughing a field. Prior to institution of the present case, the petitioner was made accused in Chautham P.S. Case No. 79 of 2015 for the offences punishable under Section-307 & other minor sections of the Indian Penal Code and 27 of the Arms Act and except the present case as well as above-said case, the petitioner does not have any criminal antecedent and he is languishing in jail custody since 25-11-2015.

Patna High Court Cr.Misc. No.38898 of 2016 (2) dt.20-09-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chautham P.S.
