2. The petitioner is in custody in connection with N.D.P.S Case No. 25 of 2023 arising out of Ramgarhwa P.S. Case No. 21 of 2023 for the offence punishable under sections 8, 20, 22 (B) ii (C) of the Narcotic Drugs and Psychotropic Substances Act lodged on 20.01.2023 by the informant, Indrajeet Paswan.

3. As per the prosecution story, the informant alleged that while returning to the police station after patrolling duty, found a person with white colour plastic bag, apprehended, he was the present petitioner and the bag contained 'charas'. Altogether, 5 kilograms and 72 grams of 'charas' were recovered/seized. Accordingly, the FIR.

4. Though the learned counsel for the petitioner took

Patna High Court CR. MISC. No.57262 of 2024(3) dt.25-09-2024 2/2 this Court to the period of custody, Mr. Jitendra Kumar Singh, learned APP for the State submits that the commercial quantity is one kilogram and the recovery is/are way beyond that.

5. Considering the aforesaid fact, no case of bail is made out and it is accordingly rejected.

6. In view of the fact that the petitioner has remained in custody since 21.01.2023 (paragraph-4 of the petition), the learned Trial Court is requested to pick up the thread and do the needful so that the trial is taken to its logical conclusion at an earliest.
