The petitioner seeks bail in a case instituted for the offences under Sections 120B read with 409, 420, 467, 468, 477A of the Indian Penal Code and 13(2) read with 13(1)(c)(d) of the Prevention of Corruption Act.

The prosecution case in short is that huge amount meant for MGNREGA scheme and old aged pension scheme was misappropriate by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.3.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

Patna High Court CR. MISC. No.55860 of 2019(2) dt.06-09-2019 2/2 submitted in the present case. The petitioner has falsely been implicated in the present case. The petitioner was to compare the documents of the depositors. He was not the Disbursing Officer nor any payments have been made by him. Except for this, there is no other substantive evidence to suggest his implication in the present case. Other co-accused has been granted bail vide Annexure-2 series to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, C.B.I.-II, Patna in connection with Special Case No. 1/2013 (R/C/2(A)13).
