2. The petitioners apprehend their arrest in connection with Bibhutipur P.S. Case No. 175 of 2023, registered for the offences punishable under Sections 341, 323, 354, 354(B), 379, 504, 506/34 of the Indian Penal Code.

3. As per allegation, the petitioners were forcibly filling the soil on the land of the informant and when the informant objected, petitioner no. 1 caught hold of her locks and thrashed her to the ground, as a result, she fell down. The petitioners tried to outrage her modesty. Further, the accused persons snatched mangalsutra from her neck.

4. The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.53757 of 2023(3) dt.08-11-2023 2/2 that admittedly, there is land dispute between the parties. The impugned order shows itself that no injury has been suffered by the informant or any member of her family. One case has also been filed by husband of the informant, details whereof has been given by filing supplementary affidavit.

5. Learned counsel for the informant has opposed the prayer for bail and submitted that the petitioner has dishonored the modesty of the informant and he does not deserve the privileges for bail.

Considering the above-mentioned facts and circumstances as well as there is land dispute between the parties and the fact that no injury has been caused to anybody, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur in connection with Bibhutipur P.S. Case No. 175 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
