JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-05-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard Mr. Kumar Ranjit Ranjan, learned counsel for the petitioner, Mr. Manoj Kumar Singh, learned counsel representing Narcotics Control Bureau, Patna and Mr. Dinesh Singh, learned APP for the State.
The petitioner in the present case is seeking regular bail in connection with Special Case No. 4 of 2019 arising out of F.No. NCB/PZU/V 02 of 2019 registered for the offences punishable under Sections 8, 20, 25 & 29 of Narcotic Drugs & Psychotropic Substances Act, 1985 (in short 'N.D.P.S. Act'). Learned counsel for the petitioner submits that as per the
Patna High Court CR. MISC. No.8866 of 2021(2) dt.04-05-2021 2/2 prosecution story the petitioner was apprehended while he was driving the truck in question and there is a seizure of 766 Kg brown colour dried ganja. It is, however, submitted that the petitioner is in custody since 11.01.2019 and the trial is still pending. Learned counsel for the Narcotics Control Bureau submits that the trial in this case has already begun and one of the witnesses has been examined so far. It is, thus, submitted that the trial is likely to be concluded very soon. It is further submitted that in view of the huge quantity of ganja rigours of Section 37 of the N.D.P.S. Act would also be attracted.
Considering the facts and circumstances of the case wherein the trial has already begun and the witnesses are being examined, in the nature of the seriousness of the offence alleged and the rigours of Section 37 of the N.D.P.S. Act, this Court is not inclined to enlarge the petitioner on regular bail. The prayer for regular bail of the petitioner is, thus, refused. Let the trial be expedited and all endeavours be made to conclude the trial as early as possible.
The application is disposed of accordingly.
