2. In this case, the petitioner is seeking regular bail in connection with Darpa P.S. Case No. 69 of 2024 arising out of NDPS G.R. Case No. 41 of 2024, registered for the offences punishable under Sections 8/20(b)(ii)(c)/23/25 of the NDPS Act.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence. Seeing the police party, the petitioner along with coaccused Arvind Kumar started fleeing away but they were apprehended. On search, 4.872 kg of ganja and a mobile set were recovered from the plastic bag, kept in the motorcycle.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.56003 of 2024(2) dt.02-08-2024 2/2 this case. He is a person of clean antecedent. He is not the owner of the said motorcycle. Nothing has been recovered from his conscious possession and he is under custody since 08.05.2024. He has submitted further that co-accused Mithilesh Devi has been granted bail by this Court in Cr. Misc. No. 48837 of 2024 vide order dated 18.07.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner, above-named, is directed to furnish bail bond after six months from today and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in connection with Darpa P.S. Case No. 69 of 2024 arising out of NDPS G.R. Case No. 41 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
