The petitioner apprehends his arrest in connection with Barhat P.S. Case No. 18 of 2019, registered for the offence under Sections 419, 420 and 468/34 of the Indian Penal Code and Section 10 of the Bihar Conduct Examination Act. The allegation against the petitioner is that petitioner was the examinee of matriculation examination and in his place one Rupesh Kumar was found appearing in the examination. Mr. Saket Gupta, learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case, inasmuch as no body impersonated the petitioner, as the entry in the examination hall, is given only after verifying the admit card and other documents.

No.48788 of 2019(2) dt.06-08-2019 2/2 Learned counsel further submits that petitioner is a student of tender age of 17 years and be released on anticipatory bail keeping in view the career of the petitioner. After having heard learned counsel for the parties and taking into consideration the fact that the petitioner is the examinee of matriculation examination and further, he is a student of tender age, accordingly, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui, in connection with Barhat P.S. Case No. 18 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. and also with a condition that one of the bailors must be the father of the petitioner.
