The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 498A/34 of the Indian Penal Code.
The informant alleged that she was married to Pragyarakshit Vidyarthi on 24.11.2003 but her husband, brotherin-law and sister-in-law and other relatives of her husband
Patna High Court CR. MISC. No.51130 of 2019(3) dt.18-11-2019 2/3 demanded Rs. 50 lakhs and a four wheeler vehicle. The informant went to her Sasural but they continued their demand and subjected her to all sorts of torture. She further alleged that she went to USA with her husband and she gave birth to two children but her husband boarded her to an airplane bound to India. Her husband is earning Rs. 8 lakh per month. She further disclosed that on 28.05.2017 her in-laws brutally assaulted her and drove her out from the house and she came to her Naihar. On 10.02.2019 her brother-in-law (Bhainsur), the petitioner, and her sister-in-law, Rina Vidyarthi, along with others came and asked her to withdraw her application before Women Commission and thereafter they abused and threatened the informant and her parents.
Learned counsel for the petitioners submits that petitioner no. 1 is Gotni, petitioner no. 2 is mother-in-law and petitioner no. 3 is maternal (phua) mother-in-law of the informant. He submits that petitioner no. 1 lives with her husband at Harmu Ranchi and petitioner no. 2 also with them whereas petitioner no. 3 lives at Doranda Ranchi. He submits that there is no specific allegation against the petitioners. He further submits that similarly situated co-accused has been granted the anticipatory bail by a coordinate Bench of this Court
Patna High Court CR. MISC. No.51130 of 2019(3) dt.18-11-2019 3/3 in Cr. Misc. No. 51258 of 2019 on 17.08.2019. In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Mahila Police Station Case No. 04 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
