This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing the order dated 25.09.2017 passed by the learned Sessions Judge, Patna in Cr. Revision No.613 of 2017 whereby he has dismissed the revision application preferred by the petitioner against the order dated 17.08.2017 passed by the learned Judicial Magistrate, 1st Class, Patna City in G.R. No.989 of 2006 arising out of Agamkuan P.S. Case No.221 of 2006 whereby the learned Magistrate had rejected the petition of the petitioner dated 05.08.2017 preferred under Section 311 of the Cr.P.C. for summoning some of the witnesses after final stage of argument of
Patna High Court Cr.Misc. No.8759 of 2018 (3) dt.20-08-2018 2/2 the case.
After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application. Leave is granted.
