JUSTICE SANDEEP KUMAR ORAL ORDER 22-08-2023 This application has been filed for quashing of the order dated 14.06.2022 passed by the learned Judicial Magistrate, 1st Class, Gaya, in Complaint Case No.695 of 2021, by which the learned Magistrate has found prima facie case against the petitioner for the offence under section 498-A /34 of the Indian Penal Code.

As per the complaint petition, the marriage of opposite party no.2 was solemnized with the son of the petitioner according to Hindu customs. It is alleged that after the marriage, all the accused persons including the petitioner demanded dowry from the opposite party no.2. On nonfulfillment of demand of dowry, the accused persons tortured the opposite party no.2 physically and mentally.

Considered the submissions of the parties.

From reading of the complaint petition, prima facie it appears that the allegation against the petitioner is serious. Hence, I do not find any illegality and infirmity in the impugned order. 4.

Accordingly, this application is dismissed.
