The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363, 364A and 34of the Indian Penal Code.

Accusation is of kidnapping the daughter of the informant.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled and unreasonableness of the accusation itself reflects that mother and son both are made accused for committing the alleged offence together.

Since the victim named the petitioner in 164 Cr.P.C. statement and the medical board assessed her age between 1617 years, this Court is not inclined to grant anticipatory bail to

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Phulparas P.S. Case No.125 of 2014, pending before the learned Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani.

With the above observation, this application is, accordingly, disposed off.
