The petitioner seeks bail in a case instituted for the offence punishable under Section 414/34 of the Indian Penal Code.

It is submitted that one Vinit Kumar was arrested with motorcycle alleged to be stolen one, and on his confessional statement, police raided the house of the petitioner and recovered one motorcycle from his house.

It has been submitted on behalf of the petitioner that other co-accused Chandan Kumar from whose possession a motorcycle has been recovered, has been granted bail by Coordinate Bench of this Court vide Cr. Misc. No. 43663 of 2016

Patna High Court Cr.Misc. No.54133 of 2016 (2) dt.21-12-2016 2/2 passed on 14.12.2016 and petitioner is said to be in custody since 28.06. 2016.

In the aforesaid circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case No. 415 of 2016.
