JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-10-2021 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner no.2, since during the pendency of this application, he has been arrested. Permission is accorded.

Accordingly, the application of petitioner no.2 is dismissed as withdrawn.

Heard learned counsel for the petitioner no.1 and the learned A.P.P. for the State.

The petitioner no.1 apprehends his arrest in connection with Nanpur P.S. Case No. 217 of 2020 registered under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.8873 of 2021(3) dt.25-10-2021 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The first information report itself shows that there is no specific allegation against the petitioner. Further, he submits that there is case and counter case between the parties.

Having considered the facts and circumstances of the case, let the above named petitioner no. 1 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Pupri, Sitamarhi in connection with Nanpur P.S. Case No. 217 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
