Heard Mr. Ravi Ranjan, learned counsel for the petitioner and Mr. Awadhesh Pandey learned counsel for the Union of India.

The petitioner, who is languishing in custody 15.06.2017 has preferred the present application for grant of bail in a case registered for the offences under Sections 8 and 20 of the NDPS Act, 1985.

The prosecution case, as per the complaint forwarded by A.K. Rai, Intelligence Officer, Narcotics Control Bureau, Patna Zone Unit, is to the effect that two persons sitting in a truck, were intercepted by a joint team of STF Patna and NCB

Patna High Court CR. MISC. No.54136 of 2019(6) dt.29-05-2020 2/3 Patna on 15.06.2017 near Suvidha Line Hotel, Kazi Jnda Chowk NH-28, Samastipur- Muzaffarpur road. It is alleged that from the truck, 810 Kg ganja were recovered. The petitioner is alleged to be the driver of the truck in question. Learned counsel for the petitioner submits that the petitioner was not aware about the articles loaded in the truck in question and a statement has been made in paragraph no. 3 of the petitioner that the petitioner is having no criminal antecedent. It is further submitted that the investigation has already been concluded.

Learned counsel for the Union of Indian submits that recovery of commercial quantity of ganja has been made from the truck which was being driven by the petitioner at the time of interception and the trial is at the fag end. Considering the commercial quantity of recovery of ganja and advance stage of the trial, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected in connection with N.C.B. Case No. 10 of 2017, pending in the Court of learned 1st Additional Sessions Judge, Muzaffarpur.

However, it is expected from the learned trial court to
