JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 414 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

Petitioner was, allegedly, caught along with others while they had assembled to make preparation for committing dacoity and on being searched; one loaded country-made pistol and one live cartridge were recovered from conscious possession of the petitioner.

The petitioner is languishing in jail custody since 2207-2016 and does not have any criminal antecedent.
