ANJANA MISHRA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and the learned counsel for the Bihar State Food Corporation as well as the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Buxar(I) P.S. Case No.108 of 2015 for allegedly having committed the offence under Sections 406, 420 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that an allegation has been made against the petitioner for defalcation of paddy to the tune of `.33,16,204/-. He further submits that the petitioner is willing and ready to pay 20% of the alleged defalcated amount within a period of four months.

No.30127 of 2015 (3) dt.29-10-2015 2/2 Considering the offer made by the petitioner and that other similarly situated rice millers have been extended the benefit of anticipatory bail under such condition, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar(I) P.S. Case No.108 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is made clear that the aforementioned amount of 20% must be paid by the petitioner within a period of four months from the date of this order, failing which it shall be open for the opposite party to move this Court for modification of the present order.
