The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/324/307/504/34 of the Indian Penal Code. It is alleged that the petitioner and co-accused Rajeev Mahto came to the door of the informant and started abusing when protest was made, the informant caused injury with knife on the chest of the informant whereas co-accused Rajeev Mahto assaulted wife of the informant with fists and slaps and snatched a chain from her neck.
It is submitted by learned counsel for the petitioner that the injury has been found to be skin deep simple in nature and a statement has been made in paragraph 3 of the petition
Patna High Court Cr.Misc. No.30239 of 2015 (2) dt.30-07-2015 2/2 that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Riga P.S. Case No.139 of 2015, pending before the learned Chief Judicial Magistrate, Sitamarhi.
With the above observation, this application is, accordingly, disposed off.
