The petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 366A/34 of the Indian Penal Code.

Informant has alleged that on 29.4.2019, the accused persons including the petitioner enticed away her minor daughter, Pooja Kumari, for the purpose of marriage. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. It has further been submitted that petitioner is elder brother of coaccused Virendra Das with whom daughter of informant had love affair and both of them fled away on their own volition and

Similarly placed co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 16.08.2019 passed in Cr. Misc. No.50745 of 2019. Learned counsel for the informant has vehemently opposed the prayer for bail of the petitioner. Considering the aforesaid facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner vide order dated 06.08.2019 is hereby confirmed with similar terms and conditions.
