Petitioner seeks bail in a case registered under sections 399, 402, 419 of the Indian Penal Code, sections 47(a), 54 of the Excise act and sections 20, 22 of the NDPS Act.

Petitioner and four co- accused were caught while they along with others had assembled to make preparation for committing dacoity and ganja as well as other articles are said to have been recovered but first information report goes to show that neither any firearm nor any other weapon was recovered from the conscious possession of the petitioner.

No doubt, petitioner does have criminal antecedent but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge I, Patna in
