16-12-2015 Heard Sri Jai Krishna Prasad, learned counsel for petitioners and learned A.C. to Govt. Pleader - 20. The present petition has been filed with a prayer to restore C.W.J.C. No. 12451 of 2008, which stood dismissed due to non-compliance of peremptory order dated 08-05-2015. By the said order, learned counsel for petitioners was directed to take step for service of notice on newly added respondent no. 7 by both process i.e. ordinary as well as registered post with A/D, for which, requisites were directed to be peremptorily filed by 22nd May, 2015.

Learned counsel for petitioners has explained the reason for non-compliance of peremptory order, which is sufficient to persuade the Court to condone the same. Accordingly, the restoration petition is allowed.

Patna High Court MJC No.2190 of 2015 (3) dt.16-12-2015 2/2 Let C.W.J.C. No. 12451 of 2008 be restored to its original file, provided order dated 08-05-2015 is complied with by 8th January, 2016.
