The petitioner seeks bail in connection with Rajepur P.S. Case No.111 of 2016 registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.

Allegedly, during search of the house of the petitioner, a loaded country-made rifle, kept in concealed manner on a slab of the room, was recovered and further, two Samsung mobiles were also seized.

Submission is of false implication and that the alleged seized arms have not been found effective so the case does not

Patna High Court Cr.Misc. No.54343 of 2016 (3) dt.11-01-2017 come under the purview of Sections 25 and 26 of the Arms Act. Petitioner is in custody since 30.08.2016 and as such, he deserves sympathetic consideration to which the learned A.P.P. opposes. In the facts and circumstances stated above, the petitioner above named is directed to be released on bail after completion of six months in custody on execution of bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Rajepur P.S. Case No.111 of 2016, subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
