JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Samastipur (Town) P.S. Case No. 36 of 2018, registered for offences punishable under Section 379 of the Indian Penal Code.

Allegation is of recovery of one motorcycle from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of confessional statement of co-accused person and nothing has been recovered from his conscious possession. Further submission is that though the petitioner is accused in two more cases, but he is on bail in both the cases and he is in judicial custody since 04.06.2018.

Heard learned A.P.P. also.

No.67156 of 2018(2) dt.27-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur (Town) P.S. Case No. 36 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
