JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2016 Heard Sri Pramod Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 08.07.2016 in Kurhani P.S. Case No.197/2016 registered for the offence under Sections 419, 420, 341, 323, 379, 385, 467, 468/34 of the Indian Penal Code, has prayed for grant of bail, primarily on the ground that one of the co-accused on similar accusation has been granted bail. By way of referring to the statement made in paragraph-3 of the petition, it was argued that the petitioner is having clean antecedent.
Keeping in view the nature of accusation, clean antecedent of the petitioner as well as the ground that one of the co-accused on similar accusation has been granted bail, there is no
Patna High Court Cr.Misc. No.42985 of 2016 (2) dt.17-10-2016 2/2 reason to further detain the petitioner. Accordingly, let the petitioner, namely, Pawan Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kurhani P.S. Case No.197/2016.
