====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 18.06.2019 in a case for the offence registered under Sections 448, 307, 326, 504/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that 03.03.2019 while the informant was sitting at his Darwaza with his wife, the accused persons including the petitioner came and started abusing the informant which was objected by him, whereafter, the petitioner and co-accused Arun Bhagat fired from their pistol upon the informant with intention to kill him which hit in the left leg of his wife causing fire arm injury. On hullah, vicinity people came and accused persons fled away. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent.

The petitioner has falsely been implicated in the present case. The petitioner alongwith other co-accused Arun Bhagat is said to have fired upon the informant which hit on the left leg of his wife. The injury is on non-vital of her body. There is only single injury found on the left leg of the wife of the informant. The daughter of the informant has filed a petition in the learned Chief Judicial Magistrate, Sitamarhi where she has denied the allegation made against this petitioner and other co-accused Vickki Kumar @ Satyam Kumar, vide Annexure-2 to the present application.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Runnisaidpur P.S. Case No. 85 of 2019.
