The petitioner seeks bail in a case registered under Sections 413, 414 and 120(B) of the Indian Penal Code. Prosecution case, in short, is that the informant got information that the petitioner has kept looted item in his house. The informant along with other police officials arrived at the house of the petitioner and the house of the petitioner was searched. On search, he found a small sack beneath the cot. When the sack was opened, some silver ornaments were found. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.07.2022. Charge sheet has been submitted in the present case. There is no allegation of

The petitioner is said to be the goldsmith. He had no knowledge that the recovered articles are stolen property. He has been made accused due to mistake of fact. The petitioner has not been put on T.I.P. to ascertain his participation in the alleged occurrence. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Sikarahana at Dhaka, East Champaran in connection with Ghorasahan P.S. case No.79 of 2017.
