JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 The present writ petition has been filed seeking the following reliefs:- "(i) For Direction/order to the District Magistrate, Banka (Respondent No.3) to take a rapid action against the Circle officer, Rajaun (Respondent No.6) for their deliberate disobedience of order of higher officer the Land Reforms Deputy Collector, Banka dated
Patna High Court CWJC No.13959 of 2022(2) dt.09-05-2023 2/3 23/08/2013 and several directions in the matter of other higher authorities specially SubDivisional Officer, Banka and further he may be directed to do justice with a person (Petitioner) running for the peaceful life and property, since the year 2013 to 2022 for all cause but big interference of Private Respondents by uses muscles power/money power and idle treatment of Circle Officer, Rajaun as well as Officer-inCharge, Rajaun. (ii) For Direction/Order to the Disaster Management Department, Unit Banka to look into the matter of air pollution where a latring Tank is not wash out since several years due to illegal interference of 0.
P/Respondents and very unfortunate manner the families are compelled for leaving out of the house for their natural call as well as natural leading of life and cry of petitioner not properly taken into consideration by the local authority i.e. C.O., Rajaun & S.H.0.-cum- Officer-in-Charge, Rajaun Police Station in spite of orders of higher authorities." At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
