JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case is that the informant performed love marriage with the victim Pappu Kumar Yadav. On 16.1.2015 the husband of the informant went outside his house but did not return. Subsequently, the dead body of the husband of the informant was recovered. Suspicion was raised against the petitioner since the petitioner earlier gave threatening to the husband of the informant.

It is submitted by the learned counsel for the petitioner that admittedly there is no eye witness to the occurrence and only on suspicion the accusation has been levelled against the

More over, the victim had illicit relationship with some one else also hence it is suspected that he might have been killed due to his misconduct. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that co accused Sintu Yadav has been granted anticipatory bail vide Cr. Misc. No. 20054 of 2015. Considering the suspicious nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Supaul in connection with Tribeniganj P.S. Case No. 15 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
