JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section-273 of the Indian Penal Code and 47(a) of the Excise Act.
Sixteen bottles Indian made foreign liquor were recovered from a bag which had been kept at railway platform and petitioners were found sitting near the aforesaid bag. Submission on behalf of petitioners is that petitioners are in jail custody since 04-06-2016 and as a matter of fact, nothing was recovered from their possession and they do not have any concern with the seized bag.
Considering the above-said facts and circumstances
Patna High Court Cr.Misc. No.46987 of 2016 (2) dt.27-10-2016 2/2 of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bakhtiyarpur G.R.P. P.S. Case No. 31 of 2016 to the satisfaction of learned Railway Judicial Magistrate, Patna.
