2. The petitioner (in both case) apprehends his arrest in a case registered for the offence under Sections 304(B)/ 34 of the Indian Penal Code.

3. It is a case of 'Dowry Death'.

4. Petitioners are nephew of the deceased and living separately since last 15 years and have got no concern with the affairs of deceased and her husband. There is general and

As per F.I.R., the alleged occurrence took place on 16.09.2020, but F.I.R. has been registered on 03.11.2020 after a lapse of one & half months without any plausible explanation of delay. As a matter of fact, the sister of informant committed suicide, for which, husband of deceased informed the police and thereafter, U.D. Case No. 9 of 2020 was registered and after investigation, the police exonerated husband of the deceased.

5. Learned A.P.Ps. for the State opposed the prayer for anticipatory bail of petitioners.

6. However, considering the aforesaid facts and circumstances, let the petitioner (in both cases) namely Arshad Ansari and Irfan Ansari, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. - 13, Rohtas at Sasaram in connection with Shivsagar P.S. Case No. 337 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C./Section 482 of the B.N.S.S., 2023.
